Andrew Brereton, a 19-year-old Morgan Hill man arrested for exposing himself to several first-grade girls in a Jackson Elementary School restroom in June 2002, is scheduled to be sentenced next week.

Superior Court Judge Ray Cunningham will decide Brereton’s punishment on Wednesday, Dec. 3, at 9 a.m. in Department 92 at the South County Justice Center, Monterey Road at Highland Avenue in San Martin. He may also determine whether Brereton will have to register as a sex offender.

Deputy District Attorney Mark Hood is expected to ask for jail time and a substantial length of probation instead of prison so Brereton can be under court supervision the longest period of time.

Brereton was also arrested on charges of causing a disruptive presence at schools (specified for sex offenders) and lewd and obscene conduct and, later, on charges of forging a check. He pleaded “nolo contendere” (no contest) on May 9, 2003, to all the charges.

Brereton previously had been ordered to stay at least 300 feet away from the school, Jackson Park and any place where children congregate. Because he was living at the family home at 16685 Trail Drive, which immediately borders school property, Brereton was moved to a home on South Monterey Road.

Brereton has been supervised by the county Pretrial Services Office, Hood said. They have monitored his activities to ensure that he obeyed all previously issued protective orders.

To help the Jackson School victims and their classmates cope with the incident’s aftermath and to give children tools to combat any future incidents, parents held an “Escape School” shortly after the arrest.
