Pair believed to have been drinking, breaking windows at gas

Morgan Hill – A broken leg didn’t stop a Morgan Hill man on parole for rape from allegedly rampaging around the city with a man on probation Tuesday night and early Wednesday morning.

Morgan Hill police Sgt. David Swing said it wasn’t clear when Danny Brown’s leg was broken, but when he and Nicholas Kashvari were discovered “possibly sleeping” under one of the benches at the Community and Cultural Center at Monterey Road and Dunne Avenue.

“They were both intoxicated,” Swing said. “Mr. Brown’s leg was already broken when he was found under the bench.”

Both men were summarily taken into custody without incident by Sgt. Jerry Neumayer, Cpl. Ray Ramos and Officers Curtis Berlin and Rick Vestal, he added.

Brown, 23, who is listed as a transient, and Kashvari, 28, also a transient, were booked into Santa Clara County Jail. Brown was first treated at a hospital emergency room.

Kashvari, who was on probation for drug charges, was booked in jail on charges of alleged vandalism, trespassing and probation violation. Brown was taken to jail on charges of alleged vandalism, trespassing and parole violation.

The two men apparently were drinking together Tuesday night and ended up allegedly vandalizing several businesses in the city. Windows were broken at the 76 gas station at the corner of Monterey Road and Dunne Avenue and at the South County Realty on Monterey Road.

The pair then apparently moved to the Community and Cultural Center, Swing said. They allegedly broke a window of the building, triggering a silent alarm. They may have entered the building.

When Neumayer and Berlin arrived just after 5am Wednesday, they found Brown and Kashvari sleeping under a bench.
