A 17-year-old San Jose male has been charged with rape and sexual battery after an incident at a party in Morgan Hill on July 20.

Morgan Hill Police Cmdr. Joe Sampson said a 14-year-old Morgan Hill girl reported the rape the following day.

“This has been a lengthy and complicated investigation,” Sampson said Monday. “The girl, who lives in Morgan Hill, is from another country. One parent lives here, another in the other country … But we were able to complete the investigation Friday, and charges were filed Friday evening.”

The alleged rape took place during a party Wednesday evening, which the girl told officers was at a residence “off East Dunne somewhere.”

Sampson said the girl was visiting with friends, went to the party and met the San Jose teen.

“There was a little bit of drinking, maybe a little bit of something else, and the boy starts to make advances,” he said. “The victim told him ‘no no no,’ but he continues to make advances, she continues to resist, but the active rape was completed.”

After the rape, Sampson said, the girl came out of the house and told her friends, gathered in the garage, what had happened. The friends then let the parents at the residence know, and the police were contacted.

“The guy probably thought he should leave at this point, before officers arrived, but we were able to locate him in San Jose and his parents, since he is a minor,” said Sampson.

The teen was released to his parents’ custody, he said, because Juvenile Hall will not accept someone on a rape charge unless they have a “prior history or proclivity” for rape.
