A registered sex offender who was arrested this spring in Morgan Hill for being on school property has been arrested again in San Jose.
Daniel Duran, 42, was arrested Tuesday in Willow Glen after an investigation by San Jose police officers following the alleged sexual assault of a realtor, according to San Jose police officer Jermaine Thomas.
Duran, of San Jose, has a history of violent sexual attacks. He was convicted of forcible rape in 1988 and assault with intent to commit rape in 1999.
Thomas said a realtor was conducting an open house in the neighborhood of Curtner Avenue and Canoas Gardens on Sunday when Duran allegedly approached her and sexually assaulted her. The woman attempted to fight him off, according to police, and he ran from the home when another person arrived.
The woman identified Duran for San Jose police officers, and he was arrested without incident on Tuesday and booked into Santa Clara County Jail for sexual assault.
Morgan Hill police officers arrested Duran April 4 on a charge of being a registered sex offender on the Nordstrom Elementary School grounds. He was released Aug. 13 and was spotted again casing neighborhoods near the end of August but was not arrested.
At that time, Duran was seen driving a green Honda Prelude, allegedly soliciting construction jobs and watching a child in the area of the school for approximately 10 minutes.
After leaving his business card at a home under construction near Nordstrom, residents said, he offered to help a homeowner with home repair projects. He also asked the homeowner about purchasing a nearby home.
Morgan Hill police Cmdr. David Swing said one of the residents, who is a realtor, recognized Duran from prior incidents and confronted him about his presence in the neighborhood, causing him to leave. After driving a short distance away, Swing said, he was recognized again, and a neighbor of the realtor told Duran he needed to leave the city. He reportedly then left, driving north on Highway 101.
Earlier this year, residents in Pleasanton and Gilroy, as well as Morgan Hill, complained about Duran’s behavior.
He was spotted in numerous locations around Morgan Hill during the week of March 19. Realtors reported he was loitering outside their offices and at homes for sale, saying God had “guided” him to purchase a home and asking people to pray with him.
