Authorities are investigating a swastika flag that was displayed on the Burnett Avenue Highway 101 overpass in Morgan Hill during rush-hour traffic the afternoon of March 21.

About 3:23pm, deputies from the Santa Clara County Sheriff’s Office responded to the overpass on a report of a swastika flag hanging on the railing, facing southbound traffic on U.S. 101, Sheriff’s Communication Officer Books Jarosz said. 

Arriving deputies removed the flag and began investigating the incident as a possible hate crime, Jarosz said. Investigators identified and interviewed a person responsible for hanging the flag. 

The suspect has not been publicly identified by police or charged with a crime. The case will be sent to the Santa Clara County District Attorney’s Office for further investigation and potential prosecution, authorities said. 

Morgan Hill Police officers also responded to the incident when it was reported Friday afternoon, according to MHPD Sgt. Scott Purvis. When MHPD officers arrived, the California Highway Patrol was on the scene.

The location where the swastika flag was reported is located in unincorporated Morgan Hill. It is also a site where demonstrators supporting President Donald Trump often gather on Friday afternoons. 

Photos of the swastika flag posted to social media on March 21 also show a Russian flag flying next to it. 

Morgan Hill Mayor Mark Turner issued a statement about the “disturbing” swastika flag incident on March 21. 

His statement also referenced an alleged assault of Muslim residents that occurred on March 7 in Morgan Hill. That incident is also being investigated by MHPD and the DA’s office. 

“It’s important to put these incidents in perspective and to recognize that while these actions are indeed unacceptable and hurtful, they do not define our town or the values we hold dear,” says the mayor’s statement, which he posted to his Facebook account. “Morgan Hill has always been a community grounded in kindness, respect and inclusion. The actions of a few individuals who seek to sow division or spread hate are isolated and do not represent the collective spirit of this town. Hate and intolerance are the actions of individuals, not the character of our community.”
