Woman accuses boyfriend of choking her during argument
Morgan Hill – An argument over food apparently led to a fight which ended with a Morgan Hill man in Santa Clara County Jail for alleged domestic assault.

Richard Diaz, 51, was arrested Thursday evening after a neighbor called police to report a fight.

Morgan Hill police Cmdr. Joe Samson said police dispatchers received a call at 7:50pm reporting that Diaz was trying to choke his girlfriend during an argument.

When officers initially talked to Diaz, Sampson said, he told them his girlfriend slapped him, so he grabbed her around the waist nobody was hurt.

The girlfriend told officers the couple had been arguing all day, and this time were in the kitchen arguing when he grabbed her and started choking her. She said she was struggling, flailing around afraid she would lose consciousness, and crashed into a glass-topped table, breaking the glass.

At that point, she slapped Diaz, she told police, and ran out to her neighbor’s house.

Officers told Diaz what his girlfriend reported, and he admitted it was possible that when he grabbed her around the waist, his arm “slipped up around her neck,” Sampson said.

Diaz was arrested without incident.
