Police arrested a 41-year-old man who robbed a Morgan Hill fast food restaurant and assaulted one of the employees, according to authorities.

About 10pm Nov. 8, Morgan Hill police were dispatched to Jack In The Box, 17015 Condit Road, on a report of a robbery in progress, according to a press release from the Morgan Hill Police Department.

Officers responded to the scene and arrested Octavio Diaz as he was exiting the restaurant, police said.

As officers investigated, the learned that Diaz had entered the business and demanded money from employees, police said. The suspect assaulted a store employee and forced him to open the cash register.

Diaz allegedly simulated a weapon in his waistband while he demanded money from the employees, according to police.

Witnesses ran out of the restaurant and called 911 to report the robbery in progress.

Diaz was ultimately unable to open the cash register and was confronted by MHPD officers as he attempted to leave the restaurant, police said. He was arrested without further incident.

Police said Diaz was armed with a utility knife at the time of the incident. Nobody was injured during the robbery.

Diaz was booked at Santa Clara County Jail on suspicion of multiple felony charges.
