On the City Council consent calendar, approved 3-0 (Mayor Dennis Kennedy and Mayor Pro Tempore Hedy Chang absent on city business):

• Approved improvement agreement for Jasmine Square and authorized the City Manager to sign the agreement with South County Housing. The agreement guarantees construction of off-site improvements at the affordable housing community in development south of the Post Office on Monterey Road. The estimated cost of construction is $538,373, which SCH will pay to the city. Project review was paid from processing fees. 3-0 P

• Awarded bid for the San Perdro Ponds fencing (and gate) project to Cyclone Fence and Iron at a level of $87,010, including $25,000 for the project with additional Proposition 12 grant funding. Council also approved the intention of the Santa Clara Valley Water District to prohibit bicyclists from using the paths surrounding the ponds. The gravel and dirt paths are not considered suitable cycling surfaces; pedestrian traffic will still be allowed. The project should begin in October, 2003 and end in November, 2003. The total bid amount does not include a contingency. 3-0 P

• Adopted a resolution approving the utility undergrounding fee deferral program. The current fees are $103.00 per linear foot of frontage, which can be a significant amount to a developer and can potentially derail an otherwise attractive project. The resolution was designed to ease the effects of the undergrounding fee by providing loans to cover up to 80 percent of the cost, requiring only a 20 percent downpayment; interest rate is the Local Agency Investment Fund rate plus one-hald percent; security for the loan will vary. Loan term is five years. All loan requests above $50,000 will be brought to the council for approval. 3-0 P

• Authorized the City Manager to execute a second amendment agreement with the San Francisco law firm of Shute, Mihaly and Weinberger, LLP. The firm provides assistance with the city’s Measure P update. An additional $25,000 was approved to allow the firm to prepare for and attend a September Planning Commission meeting and an October City Council meeting to discuss the measure. The original contract was for $10,000; the first amendment was $20,000 making a total of $55,000 paid to the firm for Measure P advice. 3-0 P

• Adopted Ordinance No. 1632, new series, amending Ord. No. 1472, which allows O’Connell developers, under Measure P requirements, to substitute a caution signal and crosswalk on East Dunne Avenue at Nordstrom School for one on East Main Avenue at Live Oak High School OR to work out an alternative agreement with MHSD at the rate of $1,000 per unit. 3-0 P
