A man accused of burglary, auto theft and possession of burglary tools pleaded innocent Tuesday in Santa Clara County Superior Court.
Scott Campione, 41, of Turlock, remains in county jail in lieu of $15,000 bail. A preliminary hearing to determine if there is enough evidence to hold him for trial is scheduled for June 15 in the San Martin court facility, according to Assistant District Attorney Mark Hood, who is prosecuting the case.
The charges against Campione stem from an incident April 24 when he was shot in the biceps by MHPD Officer Steve Pennington while allegedly fleeing the scene of a burglary at the former Flying Lady Restaurant on Foothill Drive in eastern Morgan Hill.
The shooting was deemed accidental after an investigation by MHPD and the District Attorney’s Office. Pennington, who had been on paid administrative leave during the incident, returned to full regular duty May 13.
