A 13-year-old was arrested Tuesday after police say he was shot by the very man he was trying to rob.
Police responded to a report of gunshots fired early this morning near the Garlic City Club on Horlein Court in Downtown Gilroy. When officers arrived, an employee at the club said he was approached by three suspects, two armed with handguns, according to the Gilroy Police Department.
When the robbers demanded money, police said the employee retrieved a loaded firearm from his vehicle and fired, hitting one of the suspects.
The teen was not harmed, police said.
While GPD officers stayed at the scene of the attempted robbery, Santa Clara County Sheriff’s deputies searched for possible suspects. A deputy located the 13-year-old male with a gunshot wound to his hand in the area of Forest and Serafino streets, police said.
The juvenile was treated and released from Saint Louise Regional Hospital and was later interviewed and arrested on suspicion of attempted armed robbery, according to the GPD.
After conferring with the county’s juvenile probation department – and due to the suspect’s injuries and cooperation with the investigation – the suspect was released to the custody of his mother pending additional court proceedings, police said.
The suspect’s identity is not being released due to his age. The other two suspects are still at large and the investigation is ongoing, according to the GPD.
