Gilroy – A San Jose judge set a new payment plan for Lori McVicar, who embezzled more than $50,000 from a Gilroy elementary school parents club, and has yet to pay it back.
As treasurer, McVicar pilfered at least $54,533.39 from the Rod Kelley Parents Club from January 2000 to January 2001. The woman forged at least 16 checks, intended for school necessities such as library books and crayons, by replacing payees’ names with her own.
In May 2002, McVicar was convicted of grand theft and forgery, and ordered to repay the club by March 4, 2007, when her probation was due to end. But as the deadline loomed, the club complained that McVicar hadn’t paid more than half the stolen funds – a total of $29,037, according to deputy district attorney Kathy Storton.
At a February hearing, McVicar was ordered to make a $100 good-faith payment to the club by Tuesday, when she appeared in court again. Her probation was revoked, stopping the clock on her case.
McVicar failed to pay the club. Tuesday in court, she said she had the money in cash and would make the $100 payment “right away,” said Storton.
After reviewing McVicar’s financial information, the court ordered her to make $100 monthly payments for the next four months, and to return to court on June 5 with proof of payment.
“We want her making considerably higher payments,” said Storton. “She will be under intensive scrutiny.”
McVicar’s case has been placed on the Victim Restitution Payment Calendar, a new program started this year to set payment plans early for convicts who have violated their probation by failing to pay.
