Police are looking for a parolee with a history of domestic violence who allegedly assaulted his wife the evening of June 11 in Morgan Hill.
Brian Lane, 43, of Morgan Hill, is being described as a white male, 6’2″, 220 pounds with brown hair and blue eyes. He fled the residence on his bicycle before police arrived, according to Morgan Hill police Cmdr. David Swing. There is a felony affidavit on file, and Lane is “arrestable” if located, Swing added.
On parole for burglary, Lane has a record of prior domestic offenses in a different county.
The incident was reported to police at approximately 9:35pm by the victim’s 11-year-old son, Swing said. He reported that his mom and stepdad were fighting. When Morgan Hill Cpl. Ray Ramos and officers Sarah Viale and Curtis Berlin arrived, they found the woman had visible facial injuries.
She told police that she went out to buy dinner for her husband, but he didn’t like the food she purchased, so they began fighting. Swing said he began calling her names in front of her son, and she responded back. She called her son to come eat with her, when Lane turned and came towards her in an aggressive manner.
Swing said Lane used his forearm to apply pressure to his wife’s throat, then wrapped his other arm around her neck.
“When he had her in a control hold around her neck, he drops his body weight on her, dropping her to the floor,” Swing said. “In her mind, she said, she thought she was going to die … She could have broken her neck.”
She later told police she thought her son heard the incident, but didn’t see it, Swing said.
The victim had a bloody nose and a laceration on her face, as well as a sore neck. She told officers she would seek medical treatment on her own.
The case is being reviewed by the Santa Clara County District Attorney’s Office, Swing said, but because Lane could be a danger to the community, he is being sought for arrest.
