San Martin – It appears the attempted murder case against Rafael
Casas may settle out of court. The preliminary hearing last
Thursday was continued for next month, however, the district
attorney handling the case hinted that it may never go to trial.
Casas, 24, is charged with the attempted murder of a 26-year-old at
a Gilroy gas station May 7.

According to court documents, witnesses told police that Casas was assaulting a female outside a restroom at Rotten Robbie May 7 when the 26-year-old victim attempted to intervene.
Casas allegedly responded by saying, “You [expletive] with the wrong Norteño,” and fought with the victim in the parking lot, stabbing him three times in the ribs and arm.
A witness identified Casas to police as the person responsible for stabbing the victim.
“I think we’re going to settle,” said District Attorney Stuart Scott.
The preliminary hearing, which determines whether there is enough evidence to go to trial is set to continue Dec. 5 at Santa Clara Superior Court.
