The ABC’s decision to deny the alcohol license is based on a flurry of calls for police service and recent “violent incidents,” including a May 29 shooting, in the area surrounding Dirty’s, according to ABC spokesman John Carr.

“ABC has informed the owner that they will not be getting their license approved. They have been advised to stop alcohol sales and service,” Carr said.

He added that what the business does next, as far as remaining open or re-applying for a new license, is up to the owner.

Dirty’s, at 17330 Monterey Road, was in the process of transferring an alcohol license over from the owner of the previous business that operated there. Since it opened, the restaurant offered a full bar.

Legends Bar & Grill occupied the space for about two years until it closed in January. Legends was also plagued by criminal or disruptive incidents, typically involving intoxicated downtown visitors.

The downtown shooting last month sent a Gilroy man to the hospital with life-threatening injuries. Police said the shooting happened after a fight one block to the north, in the parking lot behind the Downtown Mall. It is unknown if those involved in the fight had been drinking alcohol at Dirty’s or any other downtown establishments.

Phone calls to Dirty’s listed number were unanswered, and the restaurant was closed Thursday afternoon.
