Police arrested a Gilroy man at his home last week for sexually assaulting a child.

On Wednesday, a 12-year-old Gilroy girl and her family reported 18-year-old Juan Fabian Garcia to the Morgan Hill police for sexual assault. Garcia assaulted the girl the previous weekend at a party near Hill Road and San Pedro Avenue in Morgan Hill, said Morgan Hill Police Sgt. Jerry Neumayer.

Police do not believe there was any adult supervision at the party and the suspect – but not the victim – had been drinking, Neumayer said. The girl and Garcia did know each other, he said.

“He took advantage of her,” Neumayer said. “We believe he knew how old she was.”

Police arrested Garcia at his home on Cohansey Avenue – a short, dead-end street in rural north Gilroy – without incident and booked him into county jail, police said. Prosecutors filed one count of performing a lewd act on a child, police said.
