The convicted sex offender who was stalking realtors, loitering
near homes for sale and real estate open houses and even
approaching Nordstrom Elementary School getting him arrested
earlier this month was sentenced to five months in Santa Clara
County Jail on Thursday.
San Martin – The convicted sex offender who was stalking realtors, loitering near homes for sale and real estate open houses and even approaching Nordstrom Elementary School getting him arrested earlier this month was sentenced to five months in Santa Clara County Jail on Thursday.
Santa Clara County Superior Court Judge Teresa Guerrero-Daley said Daniel Duran, 41, of San Jose would serve 30 days of probation after his five months in jail.
Duran entered a plea of “no contest,” which is the same as a guilty plea in a criminal case, to a misdemeanor charge to going onto a school campus without legitimate business. As a convicted sex offender who is required to register, it is illegal for him to be on a school campus unless he has written permission from a school administrator, because of legislation that went into affect Jan. 1.
After a Nordstrom Elementary School custodian saw Duran’s picture in the Times, he called to say Duran had been on the Nordstrom campus the evening of March 21. Morgan Hill Police Department Det. Kevin Beilmann and Officer David Ray, accompanied by San Jose police officers, arrested Duran at his San Jose home April 4.
Beilmann referred questions about Duran’s sentence to Supervising Deputy District Attorney Frank Carrubba, but did say Duran’s case was unique.
“This is the first time to my knowledge we’ve had a case of this kind in this county, possibly in the state,” he said.
Duran has been in custody in county jail since his April 4. His original bail of $6,000 was raised to $20,000, an unusually high amount for a misdemeanor, because of his history. His time served will count towards his sentence time, so he will serve approximately four and a half months.
There is another case pending against Duran, according to Deputy District Attorney Dan Okonkwo, who handles sex offender cases. The San Jose Police Department case involves two misdemeanor charges, one for allegedly reporting false information on a registration document and one for allegedly failing to register after unenrolling from a college.
Duran was spotted in numerous locations around Morgan Hill during the week of March 21. Realtors reported he was loitering outside their offices and at homes for sale, saying God had “guided” him to purchase a home, and asking people to pray with him.
He was convicted of forcible rape in 1988 and assault with intent to commit rape in 1999.
