Garcia sentencing delayed one week

San Martin – Sentencing for Rogelio ‘Roy’ Garcia Jr. who pleaded guilty to voluntary manslaughter was postponed until next week.

Garcia, 26, was charged with killing his former friend Jeffrey Garner, 25, the night of July 2, 2005.

The defense claimed Garcia was acting in defense of Garner’s ex-girlfriend with whom he was arguing that night.

Witnesses offered differing testimonies of the incident, including Garcia’s 18-year-old neighbor Hasan Qaddura and Garner’s 15-year-old ex-girlfriend.

Qaddura claimed Garner was unarmed when Garcia attacked him with a metal pipe. Garner’s ex said she was being beaten by him and called out for help.

Garcia will be sentenced at Santa Clara County Superior Court in San Martin Friday.
