Hearing continued for two charged with assault
Morgan Hill – Two Morgan Hill residents will have to wait until the beginning of next year before they learn if the case against them – for allegedly beating a pregnant woman and using racial epithets against her – will go to trial.
Charles Peralta, 29, and Nicole Agriesti, 21, free on $100,000 bail each, are awaiting a preliminary hearing to determine if there is sufficient evidence for a trial.
Thursday’s preliminary hearing was continued to Jan. 12 after Assistant District Attorney Mark Hood told Santa Clara County Superior Court Judge Susan Bernardini one of the Morgan Hill police officers needed to testify could not be in court Thursday.
Peralta and Agriesti are charged with assault resulting in serious bodily injury after an incident outside the apartment of the victim, Xochitl Calderon, 32, who was two months pregnant when the alleged assault took place and was hospitalized afterwards as doctors feared she would lose her child.
Toys-4-Tots collected at Starbucks on Sunday
The Santa Clara County Sheriff’s Office will help the Toys-4-Tots campaign this year seeking toys and monetary donations on Sunday at the Starbucks coffee shop at Monterey Road and Cochrane Road in north Morgan Hill.
Toys and money will be collected between 10am and 4pm in the rear parking lot of the shop.
New, unwrapped toys, donations of money and other gifts such as DVDs, videos and books will be accepted. Donors will receive a raffle ticket for each new gift donated.
Gifts for the raffle were donated by Starbucks, Extreme Fitness Center, 24-Hour Nautilus, Wells Fargo Bank, Bank of America, Family lives outreach, First Baptist Church, Sunnyslope Christian Church, El Capri Restaurant, Longhorn Restaurant, Pancho’s Restaurant and Costco.
The Sheriff’s Shark car and the Under Water Search Unit will be on display.
Second chance for Those who have Outstanding warrants
For the month of December, the Santa Clara County Sheriff’s Office is implementing a program called Operation: A Second Chance. Individuals with non-violent misdemeanor criminal and traffic warrants can receive a citation with a new court date in lieu of being booked into county jail.
Those qualifying for the program can come to the Sheriff’s Office Records Division at 55 W. Younger Ave. in San Jose to receive their citation.
Warrants stamped “No cite and release,” “No Walk-Over,” and “post and Forfeit” qualify for Operation: A Second Chance. Individuals with felony warrants and any warrant involving violence do not.

President Signs Flood Protection Bill
Pres. George W. Bush has signed the Energy and Water Development Appropriations Act of 2006, which included $40.9 million to strengthen California levees and flood control systems.
U.S. Sen. Dianne Feinstein, D-CA, and House Resources Committee Chairman Richard W. Pombo, R-Tracy, have sent a joint letter to the commander of U.S. Army Corps of Engineers, urging the Corps to begin work on the 180-day delta levee assessment immediately and to issue progress reports monthly.
“This funding should put us six months away from having complete blueprints for the most critical levee repair projects,” Pombo said. “This is yet another step forward in the process of evaluating our vulnerabilities so we can get to work of preparing for – and doing everything we can to prevent – the unthinkable from happening in California.”
