R.J. Xavier Garrett, 22, of Gilroy, faces the charge of one count of sodomy with someone younger than 18. He remains in Santa Clara County Jail on $100,000 bail and could face three years in prison.
Garrett is accused of raping a 14-year-old girl March 21 in the cottage he had been renting on the 8600 block of Delta Drive in Gilroy.
Garrett led the girl to his residence, a cottage unit behind a house on Delta Drive, after initially meeting her at a McDonald’s on 10th Street, according to court records. He then sodomized her after the girl tried to ward off his sexual advances, police said.
Garrett told police the sex was consensual, that no sodomy had occurred and that the victim had said she was 18, according to court documents.
His preliminary hearing is slated to take place 1:30 p.m. Aug. 26 in Department 105 of the South County C
